1. General Provisions.
These Purchase – Sale Rules (hereinafter referred to as the “Rules”) are a legally binding document that defines the rights, obligations, and responsibilities of the Buyer (hereinafter referred to as “You”) and the Seller (hereinafter referred to as “We”) when You purchase goods in the online store (hereinafter referred to as the “e-store”).
2. Moment of the Purchase – Sale Agreement.
2.1. The agreement between You and Us is considered concluded from the moment You, having formed a shopping cart in the e-store, indicated the delivery address, selected the payment method, and agreed with our rules, press the “Order” button.
2.2. The agreement comes into effect once We receive Your payment for the goods within 3 (three) business days and remains valid until the full delivery of the goods.
2.3. Each agreement concluded between Us and You is stored in the e-store.
2.4. The order sent and printed by email is a proforma invoice, which is used for payment.
3. Your Rights:
3.1. You have the right to purchase goods in the e-store according to these rules and the procedures established by the e-store.
3.2. You have the right to cancel the purchase – sale agreement with the e-store within 14 days from receiving the goods, except in cases where the agreement is concluded for:
3.2.1. participation in games or lotteries;
3.2.2. goods specially made for You or adapted according to Your individual order.
4. Your Obligations:
4.1. You must pay for the goods within 3 (three) business days from placing the order and accept them unless otherwise agreed.
4.2. If the data provided in your registration form changes, You must immediately update it.
4.3. By using the e-store, You agree to these purchase – sale rules and must comply with them.
5. Our Rights:
5.1. If the Buyer attempts to harm the work or stable operation of the e-store, We may, without prior notice, restrict, suspend the possibility to use the e-store, or, in exceptional cases, cancel the Buyer's registration.
5.2. We may temporarily or permanently terminate the operation of the e-store in the event of important circumstances, informing You in advance.
5.3. We may unilaterally change the terms of these rules, but You will be informed in advance of any significant changes, and You will have the opportunity to terminate the agreement if the changes are unacceptable to You.
6. Our Obligations:
6.1. To provide all the conditions for You to properly use the services provided by the e-store.
6.2. To deliver the goods You ordered to the address You specified within the agreed delivery period.
6.3. In the event of important circumstances, if We are unable to deliver the ordered goods, We undertake to offer You an equivalent product. If You refuse to accept the equivalent product, We will refund the money paid within 72 hours.
7. Delivery of Goods:
7.1. The goods are delivered by Us or Our authorized representative.
7.2. Upon delivery of the goods, You must inspect the condition of the shipment together with Us or Our authorized representative.
7.3. By signing the invoice or the delivery document, the shipment is considered handed over.
7.4. If you notice damage to the shipment, You must refuse the shipment and note this in the bill of lading. If You accept the goods and sign the bill of lading without any remarks, the shipment is considered delivered in good condition.
8. Return of Goods:
8.1. Ordered goods that are specially made for You or customized according to Your individual order are considered specially ordered items. Therefore, if these goods are of good quality, they cannot be returned or exchanged for other goods or sizes. Money for good quality goods is not refunded, and money is also not refunded if the Buyer refuses the ordered goods.
9. Responsibility:
9.1. You are fully responsible for the accuracy of the data provided in the registration form. If You provide inaccurate data in the registration form, We are not responsible for the consequences arising from this.
9.2. You are responsible for actions performed while using the e-store.
9.3. You are responsible for passing on the identification code to third parties. If third parties use Your identification code, You are responsible for the actions of the third party.
10. Sending Information:
10.1. We send all notifications to the email address provided in Your registration form.
10.2. You send all notifications and questions using the contact information provided in the "Contact" section of the e-store.
11. Protection of Personal Data under GDPR
11.1. All Your personal data is processed in accordance with the General Data Protection Regulation (GDPR) and other applicable laws of the Republic of Lithuania.
11.2. Your personal data is collected and processed solely for the purposes necessary to fulfill the order, as well as to maintain communication with You.
11.3. You have the right to access your personal data, request its correction, deletion, or restriction, and the right to object to its processing. To exercise these rights, please contact us by email: info@gofish.lt.
11.4. We retain Your personal data for as long as necessary, taking into account legal requirements and Our data processing purposes.
12. Final Provisions.
12.1. The dissemination of any information from the e-store without the written consent of the Seller is prohibited.
12.2. These rules are governed by the law of the Republic of Lithuania.
12.3. All disputes arising from the execution of these rules shall be settled through negotiations. If the parties fail to reach an agreement, the disputes are resolved in accordance with the laws of the Republic of Lithuania.
